Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the LisensyaLab mobile application, websites, and related services (together, the “Service”), operated by LisensyaLab, Inc. (“LisensyaLab”, “we”, “us”).

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create an account. If you are accessing the Service through a school or institutional program while under 18, you confirm that a parent, legal guardian, or authorized representative of your institution has consented on your behalf.

2. Your account

• You must provide accurate information when registering and keep it up to date.
• You are responsible for keeping your password confidential and for all activity that occurs under your account.
• Accounts are personal and non-transferable. You may not share, sell, or lend your credentials. We may suspend accounts showing signs of credential sharing, such as simultaneous use from many unrelated devices.
• Notify us immediately at [email protected] if you believe your account has been compromised.

3. Subscriptions, trials, and billing

Free trial

New accounts include a seven (7) day free trial. No payment is required to begin the trial. If you do not subscribe before the trial ends, your access to paid features simply stops — we do not charge you automatically at the end of a trial that you did not convert.

Paid plans

Subscription fees are stated on our pricing page and are quoted in Philippine Pesos (₱), inclusive of applicable taxes unless stated otherwise. We may change our prices; any change takes effect at your next renewal, and we will give you reasonable notice beforehand.

Where you purchase matters

• Purchases made directly from us are processed by our third-party payment provider and are governed by these Terms.
• Purchases made through the Apple App Store or Google Play are billed by Apple or Google and are additionally governed by that platform's terms. Cancellation, renewal, and refunds for those purchases must be managed through your Apple or Google account, and their refund policy takes precedence.

Renewal and cancellation

Where a plan is set to renew automatically, it continues for successive periods until canceled. You may cancel at any time, and you keep access until the end of the period you have already paid for. Canceling stops future charges; it does not retroactively refund a period already begun.

Refunds

Because the Service grants immediate access to digital content, fees are generally non-refundable once a billing period has started. We will nonetheless consider refund requests made in good faith — for example, duplicate charges, a billing error on our part, or a sustained failure of the Service — if you contact us within seven (7) days of the charge. Nothing in this section limits any right you have under the Philippine Consumer Act (RA 7394) or other applicable consumer protection law.

4. Acceptable use

You agree not to:

• Copy, reproduce, scrape, republish, distribute, or resell any part of the question bank, explanations, or other content.
• Use automated tools to extract content, or attempt to bulk-download questions.
• Reverse engineer, decompile, or attempt to derive the source code of the Service, except where such restriction is prohibited by law.
• Interfere with the Service's operation, probe its security, or attempt to gain unauthorized access to any account or system.
• Manipulate leaderboards, scores, or rankings by any dishonest means.
• Upload or transmit unlawful, defamatory, harassing, or infringing material.

We may suspend or terminate access for a breach of this section, and pursue any remedy available to us.

5. Intellectual property

All content in the Service — including questions, answer explanations, study paths, text, graphics, the LisensyaLab name and logo, and the software itself — is owned by LisensyaLab or its licensors and is protected by Philippine and international intellectual property law.

Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own examination preparation. No other rights are granted.

6. No guarantee of examination results

LisensyaLab is a study and practice tool. We do not guarantee that you will pass any licensure examination, and no statement in the Service or in our marketing should be read as such a guarantee. Our question banks are prepared with reference to the Professional Regulation Commission (PRC) Tables of Specifications, but we are not affiliated with, endorsed by, or acting on behalf of the PRC or any Professional Regulatory Board. Practice questions are our own preparation and are not actual examination questions.

7. Availability and changes to the Service

We aim to keep the Service available continuously, but we do not warrant uninterrupted or error-free operation. The Service may be unavailable during maintenance, or as a result of events outside our reasonable control. We may add, modify, or discontinue features. If we discontinue the Service entirely, we will give reasonable notice and provide a pro-rated refund for any unused portion of a prepaid subscription.

8. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. While we work to keep our content accurate and current, we do not warrant that every question, explanation, or reference is free of error or reflects the most recent change in law or professional standards.

9. Limitation of liability

To the fullest extent permitted by law, LisensyaLab and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, goodwill, or examination opportunity, arising out of or relating to your use of the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the amount you actually paid us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or gross negligence.

10. Indemnity

You agree to indemnify and hold LisensyaLab harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision would expose us or other users to material risk. Where circumstances reasonably permit, we will give you notice and an opportunity to remedy the breach. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

12. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. Where changes are material, we will notify you in the application or by email before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not accept them, you may cancel your subscription.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of laws principles. We encourage you to contact us first so we can try to resolve any dispute informally. Failing that, the parties submit to the exclusive jurisdiction of the competent courts of the City of Manila, Philippines, without prejudice to any mandatory consumer right to bring proceedings in your place of residence.

15. General

• These Terms, together with the Privacy Policy, are the entire agreement between you and LisensyaLab regarding the Service.
• If any provision is held unenforceable, the remaining provisions continue in full force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms without our written consent; we may assign them to a successor in connection with a merger, acquisition, or reorganization.
